Disaster fund created, use of moneys during a state of emergency.

192.326. There is hereby created in the state treasury the"Department of Health and Senior Services Disaster Fund", to which thegeneral assembly may appropriate moneys and from which moneys may beappropriated annually to the department of health and senior services.Moneys in the fund shall be expended during a state of emergency at thedirection of the governor and upon issuance of an emergency declarationwhich shall set forth the emergency and shall state that it requires theexpenditure of public funds to furnish immediate aid and relief. The statetreasurer shall be the custodian of the fund and the fund shall beadministered by the department of health and senior services.Notwithstanding the provisions of section 33.080, RSMo, moneys in the fundshall not lapse to the credit of general revenue at the end of thebiennium. All interest earned on the fund shall be deposited in andcredited to the fund.
