Schedule of fees to be established--nonrefundable fees--waiver offees--mammography fund.

192.764. 1. The department of health and senior services shallpromulgate rules to establish a schedule of fees to be paid by an applicantfor a specific license for sources of ionizing radiation and the renewal ofthe specific license, or by a person possessing sources of ionizing radiationwhich are subject to registration pursuant to sections 192.760 to 192.766,pursuant to the provisions of section 192.006 and chapter 536, RSMo. Thedepartment may accept a written certification from the licensee or registrantthat the items of noncompliance have been corrected instead of a follow-upinspection. If the department does not inspect a source of ionizing radiationfor a period of five consecutive years, the licensee or registrant of thesource of ionizing radiation shall be excused from payment of further licenseor registration fees as to that source of ionizing radiation until the firstlicense or registration renewal date following the time an inspection of thesource of ionizing radiation is made.

2. Except as otherwise provided in subsection 3 of this section, thedepartment of health and senior services shall assess the followingnonrefundable fees in connection with mammography authorization:

(1) Initial inspection, per radiation

machine .................................... $100.00

(2) Annual inspection, per radiation

machine .................................... $100.00

(3) Reinspection for reinstatement

of mammography authorization, per

radiation machine .......................... $100.00

(4) Department evaluation of compliance

with subdivision (1) of subsection 2

of section 192.762, first

radiation machine .......................... $500.00

(5) Each additional radiation machine .......... $400.00

3. If an applicant for mammography authorization submits anaccreditation certificate issued by the American College of Radiology thatevidences compliance with subdivision (1) of subsection 2 of section 192.766,the department shall waive the fee under subsection 2 of this section fordepartment evaluation of compliance with that provision.

4. All fees provided for in this section shall be collected by thedirector of the department of health and senior services who shall deposit thesame with the state treasurer in a fund to be known as the "Mammography Fund". The provisions of section 33.080, RSMo, to the contrary notwithstanding,money in this fund shall not be transferred and placed to the credit ofgeneral revenue at the end of the biennium, but shall be used, uponappropriation by the general assembly, for the sole purpose of carrying outthe provisions of sections 192.760 to 192.766.
