Registration required, exceptions--applications,contents--fees--renewal--penalty.

195.405. 1. Any manufacturer, wholesaler, retailer, or other person whosells, transfers, or otherwise furnishes any listed chemical specified insubsection 2 of section 195.400 to a person in this state or who receives froma source outside of this state any chemical specified in subsection 2 ofsection 195.400 shall obtain a registration for such conduct from thedepartment of health and senior services.

2. No registration shall be required of any manufacturer, wholesaler,retailer, or any pharmacist, pharmacy, physician, dentist, podiatrist,veterinarian or optometrist, who administers, dispenses or furnishes asubstance listed in subsection 2 of section 195.400 within the scope of hisprofessional practice, or other person for the sale, transfer, furnishing, orreceipt of any drug which contains any substance listed in subsection 2 ofsection 195.400 and which is lawfully sold, transferred or furnished over thecounter without a prescription or by a prescription pursuant to the federalFood, Drug, or Cosmetic Act or regulations adopted thereunder.

3. No registration shall be required of any retailer for the sale,transfer, furnishing, or receipt of any product part of whose ingredientsinclude a substance listed in subsection 2 of section 195.400 and whichproduct is lawfully sold, transferred or furnished in the ordinary course ofits business.

4. Applications for registration shall be filed in writing and signed bythe applicant, and shall set forth the name of the applicant, the business inwhich the applicant is engaged, the business address of the applicant and afull description of any substance sold, transferred, or otherwise furnished orreceived.

5. The department of health and senior services upon public notice andhearing may promulgate rules and establish reasonable fees to be chargedrelating to the registration and control of the manufacture, distribution, anddispensing of listed chemicals under subsection 2 of section 195.400.

6. Registration granted pursuant to this section may be renewed one yearfrom the date of issuance, and annually thereafter, upon the filing of arenewal application and the payment of a registration renewal fee.

7. Selling, transferring, or otherwise furnishing or receiving anysubstance listed in subsection 2 of section 195.400 without a registration isa class D felony.
