Limitations on the retail sale of methamphetamine precursordrugs--violations, penalty.

195.418. 1. The retail sale of methamphetamine precursor drugs shallbe limited to:

(1) Sales in packages containing not more than a total of three gramsof one or more methamphetamine precursor drugs, calculated in terms ofephedrine base, pseudoephedrine base and phenylpropanolamine base; and

(2) For nonliquid products, sales in blister packs, each blistercontaining not more than two dosage units, or where the use of blisterpacks is technically infeasible, sales in unit dose packets or pouches.

2. Any person holding a retail sales license pursuant to chapter 144,RSMo, who knowingly violates subsection 1 of this section is guilty of aclass A misdemeanor.

3. Any person who is considered the general owner or operator of theoutlet where ephedrine, pseudoephedrine, or phenylpropanolamine productsare available for sale who violates subsection 1 of this section shall notbe penalized pursuant to this section if such person documents that anemployee training program was in place to provide the employee withinformation on the state and federal regulations regarding ephedrine,pseudoephedrine, or phenylpropanolamine.
