Order authorizing entry for survey, grounds for.

197.280. Whenever the department has reasonable grounds tobelieve that a hospice required to be certificated under sections197.250 to 197.280 is operating without a certificate, and thedepartment is not permitted access to survey the hospice, or whena certificated hospice refuses to permit access to the departmentto survey the hospice, the department shall apply to the circuitcourt of the county in which the premises are located for anorder authorizing entry for such survey. The court shall issuethe order if it finds reasonable grounds for the survey or if itfinds that a certificated hospice has refused to permit thedepartment access to survey the hospice.
