197.345. Any health facility with a project for facilitiesor services for which a binding construction or purchase contracthas been executed prior to October 1, 1980, or health carefacility which has commenced operations prior to October 1, 1980,shall be deemed to have received a certificate of need, exceptthat such certificate of need shall be subject to forfeitureunder the provisions of subsections 8 and 9 of section 197.315.
