Report on survey, list of deficiencies, content--plan of correctionfiled with department--resurvey and administrative review procedure.

197.430. After completion of each department survey, awritten report of the findings with respect to compliance ornoncompliance with the provisions of sections 197.400 to 197.475and the standards established hereunder as well as a list ofdeficiencies found shall be prepared. A copy of the report andthe list of deficiencies found shall be served upon the homehealth agency within fifteen business days following the surveyinspection. The list of deficiencies shall specifically statethe statute or rule which the home health agency is alleged tohave violated. If the home health agency acknowledges thedeficiencies found by the survey inspection, the home healthagency shall inform the department of the time necessary forcompliance and shall file a plan of correction with thedepartment. If the home health agency does not acknowledge thedeficiencies, it may request a resurvey by the department. If,after the resurvey, the home health agency still does not agreewith the findings of the department, it may seek a review of thefindings of the department by the administrative hearingcommission.
