Increase in tax levy, procedure--ballot of submission, form.

198.263. Any district which has a lower tax levy than themaximum levy authorized by section 198.250 may increase its levyup to, but not in excess of, such maximum levy if a majority ofthe voters of the district who vote on the increase approve theincrease. The ballot of submission for a tax increase under thissection shall be in substantially the following form:

Shall the ................. Nursing Home District beauthorized to increase the annual rate of property tax from........ cents to ........ cents on the hundred dollars assessedvaluation?

â ã Yes

â ã No(Place an "X" in the square opposite the answer for which youwish to vote.)If a majority of the qualified voters casting votes thereon arein favor of the increase, the board of directors of the districtshall levy the annual rate of tax approved; but if a majority ofthe voters casting votes thereon are opposed to the increase, anyannual tax rate in effect at the time of the election shallremain in effect; provided, however, that if the voters of thedistrict have previously approved a levy and the levy has notbeen imposed, the board of directors may impose such previouslyapproved levy or portion thereof, subject to other provisions ofthe law with respect to limitation on tax revenues.
