Establishment of area, procedure.

204.654. 1. To establish a sanitary sewer improvement area, thegoverning body of the sewer district shall comply with the followingprocedure: the governing body of the district may create a sanitary sewerimprovement area when a proper petition has been signed by the owners ofrecord of four-sevenths of the property within the proposed sanitary sewerimprovement area. The petition, in order to become effective, shall befiled with the district. A proper petition for the creation of a sanitarysewer improvement area shall set forth the project name for the proposedimprovement, the general nature of the proposed improvement, the estimatedcost of such improvement, the boundaries of the proposed sanitary sewerimprovement area, the proposed method or methods of financing the project,including the estimated amount of and method for imposing user fees againstthe real property within the sanitary sewer improvement area to pay for thecost of the improvements and any bonds issued, a notice that the names ofthe signers may not be withdrawn later than seven days after the petitionis filed with the district, and a notice that the final cost of suchimprovement and the amount of revenue bonds issued shall not exceed theestimated cost of such improvement, as stated in such petition, by morethan twenty-five percent.

2. Upon filing a proper petition with the district, the governingbody may, by resolution, determine the advisability of the improvement andmay order that the area be established and that preliminary plans andspecifications for the improvement be made. Such resolution shall stateand make findings as to the project name for the proposed improvement, thenature of the improvement, the estimated cost of such improvement, theboundaries of the sanitary sewer improvement area, the proposed method ormethods of imposing assessments and, if known, proposed estimated user feeswithin the district. The resolution also shall state that the final costof such improvement within the sanitary sewer improvement area and theamount of revenue bonds issued shall not, without a new petition, exceedthe estimated cost of such improvement by more than twenty-five percent.

3. The boundaries of the proposed area shall be described by bounds,streets, or other sufficiently specific description.
