Procedure where several petitions filed--amendments.

206.040. If two or more petitions covering in part the sameterritory are filed prior to the public hearing upon the petitionwhich is first filed, the petitions shall be consolidated forpublic hearing, and hearing thereon may be continued to permitthe giving of notice of any subsequent petition or petitions. Atthe public hearing upon the petitions, the petitioners in thepetition first filed may move to amend the petition to includeany part of the territory described in the subsequent petition orpetitions, either as originally filed or as amended. Any suchmotion shall be allowed by the commissioners of the countycommission. The public hearing shall proceed upon the firstpetition as originally filed or as so amended, and furtherproceedings upon any other petitions subsequently filed shall bestayed and held in abeyance until the termination of allproceedings upon the first petition, or any petition may bedismissed or withdrawn upon motion of the petitioners therein bytheir representatives.
