Duties of state treasurer--special funds created.

208.170. 1. The state treasurer shall be treasurer andcustodian of all funds and moneys of the department and shallissue checks upon such funds or moneys in accordance with suchrules and regulations as the department shall prescribe.

2. There is hereby established as a special fund, separateand apart from the public moneys of this state, the following:

(1) Supplemental payment fund;

(2) Aid to families with dependent children fund;

(3) Relief fund;

(4) Child welfare service fund;

(5) Administration fund;

(6) Title XIX fund;

(7) Child support enforcement fund.

3. The supplemental payment fund shall consist of moneysappropriated by the state, and such moneys as may be receivedfrom the federal government or other sources for the payment ofsupplemental payments. All checks payable to recipients ofsupplemental payments shall be drawn on and paid from this fund.

4. The aid to families with dependent children fund shallconsist of moneys appropriated by the state, and such moneys asmay be received from the federal government or other sources forthe payment of aid to families with dependent children. Allchecks payable for aid to families with dependent children shallbe drawn on and paid from this fund.

5. The relief fund shall consist of moneys appropriated bythe state, and such moneys as may be received from the federalgovernment or other sources for aid or relief in cases of publiccalamity. All expenditures for aid or relief in cases of publiccalamity shall be paid from this fund.

6. The child welfare service fund shall consist of moneysappropriated by the state, and such moneys as may be receivedfrom the federal government or other sources for child welfareservices, and this fund or any portion of it may be transferredto the administration fund.

7. The administration fund shall consist of moneysappropriated by the state, and moneys received from the federalgovernment to pay the administrative costs of the department inadministering the provisions of the law. All checks payable foremployees and personal services of representatives of thedepartment shall be drawn on and paid from the administrationfund.

8. The Title XIX fund shall consist of moneys appropriatedby the state and such moneys as may be received from the federalgovernment or other sources for the payment of medical assistancerendered to eligible recipients pursuant to the Title XIX stateplan, and all checks payable on behalf of recipients shall bedrawn on and paid from this fund.

9. The child support enforcement fund shall consist ofmoneys appropriated by the state, and such moneys as may bereceived from the federal government or other sources includingmoneys representing assigned support obligations collected onbehalf of recipients of public assistance and nonrecipients ofpublic assistance, any fees collected by the department and anyincentive payments received from other states. From this fundshall be paid any moneys collected which represent assignedsupport obligations required by state law or federal law to bereturned to the obligee on whose behalf the obligation wascollected, incentive payments to political subdivisions of thisstate or to other states, any reimbursement to the federalgovernment for its respective share of payments for aid tofamilies with dependent children and administrative costsincurred by the department in the administration of the childsupport enforcement program including purchase of child supportenforcement services pursuant to the terms of cooperativeagreements entered into with political subdivisions of thisstate, appropriate courts, law enforcement officials or others.Nothing herein shall prohibit the appropriation of federal fundsto defer all administrative costs incurred by the departmentpursuant to chapter 454, RSMo, in the event that federalfinancial participation is extended to include all costs.
