Accounts for children with custodial parents in JOBS (or FUTURES),conditions, limitations--waivers required.

208.337. 1. The division may deposit funds into an accounton behalf of children whose custodial parent is a participant inthe program authorized pursuant to the provisions of sections208.400 to 208.425, and whose noncustodial parent isparticipating in a state job training and adult educationalprogram approved by the division of family services. If agreedupon by the parties, funds may also be deposited for this purposewhen the noncustodial parent terminates participation in the jobtraining or educational program, until the custodial parentcompletes participation in the program authorized pursuant to theprovisions of sections 208.400 to 208.425. The amount depositedfor each child shall not exceed the portion of current childsupport paid by the noncustodial parent, to which the state ofMissouri is entitled according to applicable state and federallaws. Money so received shall be governed by this sectionnotwithstanding other state laws and regulations to the contrary.

2. Any money deposited by the division on behalf of achild, as provided in subsection 3 of this section, shall beaccounted for in the name of the child. Any money in the accountof a child may be expended only for care or services for thechild as agreed upon by both parents. The division shall, byrule adopted pursuant to section 454.400, RSMo, and chapter 536,RSMo, establish procedures for the establishment of the accounts,use, expenditure, and accounting of the money, and the protectionof the money against theft, loss or misappropriation.

3. The division shall deposit money appropriated for thepurposes of this section with the state treasurer. Any earningsattributable to the money in the account of a child shall becredited to that child's account.

4. Each child for whose benefit funds have been received bythe division, and the parents of such child, shall be furnishedannually by the division of budget and finance of the departmentof social services with a statement listing all transactionsinvolving the funds which have been deposited on the child'sbehalf, to include each receipt and disbursement, if any.

5. (1) The director of the department of social servicesshall apply for all waivers of requirements under federal law toimplement the provisions of this section.

(2) This program shall not be implemented until the waiverhas been obtained from the Secretary of the Department of Healthand Human Services by the director of the department of socialservices.
