Division of family services to make regulations relative toexamination of applicants for pensions.

209.080. It shall be the duty of the division of familyservices to make such regulations relative to the examination ofapplicants for pension, including the examination by anophthalmologist, a physician skilled in disease of the eye, or anoptometrist, designated or approved by the division of familyservices to make such examination and of all matters deemednecessary connected with the administration of this chapter. Theexamining ophthalmologist, a physician skilled in disease of theeye, or optometrist, shall certify in writing, upon formsprovided by the division of family services, the findings of theexamination. The examination shall be provided for by thedivision of family services without charge to the applicant andshall be paid as an administrative expense. No person shall beentitled to the benefits of this chapter who shall refuse tosubmit to treatment or operation to effect a cure whenrecommended by competent medical authority and approved by thedivision of family services, but upon submission to suchtreatment or operation the pension of applicant otherwiseentitled thereto, shall be paid as in other cases: Providedfurther, that no applicant who is more than seventy-five years ofage shall be required to submit to an operation to restore his orher vision in order to come under the provisions of this chapter,but may voluntarily submit to operation.
