Informal adjustments--court may allow restitution or communityservice--supervisors of community service immune from suit--childnot an employee, when.

211.083. 1. Whenever an informal adjustment is made under theprovisions of section 211.081, the juvenile court may allow the child:

(1) To make restitution or reparation for the damage or loss causedby his offense. Any restitution or reparation shall be reasonable in viewof the child's ability to make payment or perform the reparation. Thecourt may require the clerk of the circuit court to act as receiving anddisbursing agent for any payment agreed upon;

(2) To complete a term of community service under the supervision ofthe court or an organization selected by the court.

2. Every person, organization, and agency, and each employee thereof,who supervises a child under the provisions of this section, or whobenefits from any services performed under this section as a result of aninformal adjustment, shall be immune from any suit by the child performingservices under this section, or any person deriving a cause of action fromsuch child, if such cause of action arises from the supervision of thechild's performance of services under this section and if such cause ofaction does not arise from an intentional tort or any wanton, willful, ormalicious conduct. A child performing services under this section shallnot be deemed an employee within the meaning of the provisions of chapter287, RSMo, nor shall the services of such child be deemed employment withinthe meaning of the provisions of chapter 288, RSMo.
