County commission and incorporated cemetery company to receivegrants and bequests in trust.

214.130. It shall be lawful for the county commission of anycounty in which any family burying ground or cemetery, conveyedas aforesaid to said commission, is situated, to take and holdany grant or bequest of money or bonds of the United States, orof this state, or of such county, in trust, and to apply the sameor the income thereof for the improvement of any such familyburying ground or cemetery, or any portion thereof, or in theerection, extension, adornment or preservation of any tomb,monument, vault or grave, within such burial ground or cemetery,according to the terms of any such grant or bequest, but for noother use, trust or purpose whatever; and every incorporatedcemetery company is also hereby authorized and empowered to takeand hold any like grant or bequest in trust, and to apply thesame, or the income thereof, under the direction of the board oftrustees or directors of such cemetery company, for theimprovement of such cemetery, or any portion thereof, or in theerection, extension, adornment or preservation of any tomb,monument, vault or grave within such cemetery, according to theterms of any such grant or bequest, but for no other use, trustor purpose whatever. Any court having equity jurisdiction withinthe county in which such family burying ground or cemetery issituated, shall have power and it shall be its duty to compel theperformance of any such trust upon the application of any personwhatever.
