Public cemetery failing to provide maintenance--abandonment orceasing to operate, division's duties.

214.365. Prior to any action as provided in subsection 2 ofsection 214.205, and when the division has information that apublic cemetery is not providing maintenance and care, has beenabandoned, or has ceased operation, the division may investigatethe cemetery to determine the cemetery's current status. If thedivision finds evidence that the cemetery is abandoned, is notconducting business, or is not providing maintenance and care,the division may apply to the circuit court for appointment asreceiver, trustee, or successor in trust.
