Mental health housing trust fund, created--transfers to the fund,interest, how used--department of mental health to select projects,commission approval--moneys not to lapse--St. Joseph state hospitalproceeds, use of funds.

215.054. 1. The commission shall administer, incooperation with the department of mental health, a fund to beknown as the "Mental Health Housing Trust Fund", which is herebycreated in the state treasury.

2. Notwithstanding any other provision of the law to thecontrary, any proceeds received by the state from the sale ofsurplus real property formerly used by the department of mentalhealth shall, upon appropriation, be paid into the mental healthhousing trust fund. Moneys in the mental health housing trustfund shall be invested by the state treasurer in the samedeposits and obligations in which state funds are authorized bylaw to be invested; except that, the income accruing from suchfunds shall be credited to the mental health housing trust fundon an annual basis.

3. Interest earned on moneys held in the mental healthhousing trust fund may, upon appropriation, be used to:

(1) Finance the rental, purchase, construction orsubstantial rehabilitation of community-based housing for clientsof the department of mental health who have a mental illness,developmental disability or are chemically dependent, throughgrants or loans or both;

(2) Support department of mental health housing voucherexpenses for department of mental health clients;

(3) Pay subsidies and administrative costs of consumerhome-ownership programs, for the department of mental healthclients;

(4) Provide matching grants for federal, state or localhousing projects which serve clients of the department of mentalhealth;

(5) Fifty percent of proceeds from the sale of habilitationcenter property shall, subject to appropriations, be used for theconstruction or substantial renovation of habilitation centers.

4. The department of mental health shall work incooperation with the commission in selecting the projects whichare to be funded. The commission shall review the proposals forfinancial feasibility. The commission shall fund those projectswhich are financially feasible and which are approved by thedepartment of mental health, in the priority order established bythe department. To the maximum extent possible, the proceeds ofthe sale of surplus property formerly used by the department ofmental health shall be invested in those municipalities whichcomprised the population catchment area of the facility beingdisposed of and in other municipalities in great need asdetermined by the department.

5. The commission shall manage the mental health housingtrust fund. Such management shall include, but not be limitedto, accepting deposits, reviewing and funding projects approvedby the department of mental health, and reporting to thedepartment of mental health on fund activities.

6. Notwithstanding the provisions of section 33.080, RSMo,to the contrary, money in the fund shall not be transferred andplaced to the credit of general revenue at the end of thebiennium, except by appropriation.

7. Notwithstanding the provisions of subsection 2 of thissection, the proceeds of the sale of real property known as theSt. Joseph State Hospital shall not be paid into the mentalhealth housing trust fund but shall be used for the constructionof the new state hospital in St. Joseph, Missouri.
