217.825. Sections 217.825 to 217.841 shall be known and maybe cited as the "Missouri Incarceration Reimbursement Act".
(L. 1988 H.B. 1340 & 1348 § 1)(1991) Missouri incarceration reimbursement act violates the supremacy clause and is invalidated to the extent that it conflicts with Congress's intent to award damages under 42 U.S.C.A. § 1983. State enjoined from attaching prisoner's funds received as money judgment from state in civil action by prisoner against state. Hankins v. Finnel, 759 F.Supp. 569 (W.D.Mo.).
(2005) Missouri incarceration reimbursement act is not unconstitutionally vague under facts of case. State ex rel. Nixon v. Powell, 167 S.W.3d 702 (Mo.banc).
