Grant by department of social services of division of youth servicesfacilities--notification to commissioner ofadministration--fee--terms of the lease.

219.096. 1. The director of the department of social services may grantthe use of any building or grounds of any of the facilities of the division ofyouth services for governmental, private or not-for-profit activities as longas the activities are compatible with the services of the division.

2. The director of the department shall notify the commissioner ofadministration which governmental, private or not-for-profit entities maylease such building or grounds pursuant to public bid.

3. The department shall charge such entity at least an amount to coverthe cost of utilities and services that the department furnishes to the lesseeof any building.

4. The term of the lease may be for one year or less, and the lease maycontain an option for one-year renewals of the lease if both parties agree.The lease shall include conditions that the lessee shall use and maintain theland or building for uses compatible with the services of the division. Thelease shall by its terms protect the state from liability for damagesoccurring on the property.

5. The director of the department shall sign the lease on behalf of thestate.
