Limitation of liability.

227.663. 1. As a result of the project being a public use andserving the public safety, health, and welfare, tort liability caps arehereby established in this section and made applicable to any privatepartner and such private partner's employees, agents, and insureds thatdevelops and/or operates the project under sections 227.600 to 227.669.Such tort liability caps shall be a per-person cap and a per-occurrence capand shall be in amounts identical to the tort liability caps established insection 537.610, RSMo, as such caps are annually amended by the ImplicitPrice Deflator for Personal Consumption Expenditures under subsection 5 ofsection 537.610, RSMo.

2. Commercial general liability insurance policy or policiespurchased by the private partner under sections 227.600 to 227.669 shallnot be used to expand the coverage and amount of the tort liability capsimposed in this section.
