Commissioners of the special road district, how selected.

233.180. 1. At the term of the county commission in whichsuch order is made, or at any subsequent term thereafter, thecounty commission shall appoint three commissioners of thespecial road district, who shall be voters of the district andowners of land within the district, who shall hold their officeuntil the second Tuesday in April thereafter. The voters of thedistrict shall elect three commissioners of the special roaddistrict, one of whom shall serve one year, one for two years andone for three years, and on municipal election days each yearthereafter they shall elect a commissioner of the special roaddistrict to take the place of the one whose term is about toexpire, who shall serve three years.

2. No person shall be elected or appointed commissioner ofthe special road district who is not a voter of the district.Any vacancy caused by resignation, death, removal from thedistrict of a commissioner of the special road district or saleof all land owned by him in the district shall be filled for theunexpired term by appointment by the remaining commissioners ofthe special road district. All commissioners of the special roaddistrict shall qualify by taking, subscribing and filing with thecounty clerk the oath prescribed by the constitution of thisstate, and that they will faithfully, honestly and impartiallydischarge their duties as commissioners of the special roaddistrict according to law.

3. If for any reason the board of commissioners of thespecial road district herein mentioned shall fail to fill avacancy or vacancies caused by the expiration of the term of anyone or more of the commissioners of the special road district,then the county commission is hereby authorized and required toappoint a person to fill the vacancy.
