Tools and machinery, delivery to commissioners of special roaddistrict--powers and duties--concurrent jurisdiction with specialroad subdistrict, when.

233.340. 1. The township board of trustees shall, uponthe organization of such special road district commissioners,cause all tools and machinery used for working roads belongingto the districts and parts of districts formerly existing andcomposed of territory embraced within the incorporated districtto be delivered to the special road district commissioners, forwhich such commissioners shall give receipt, and suchcommissioners shall keep and use such tools and machinery forconstructing and improving public roads and bridges.

2. The township boards shall also cause the townshiptreasurer to pay over to the treasurer of the special roaddistrict all moneys in his hands belonging to the district ordistricts that have been merged into the special road districtwhenever the board of special road district commissioners ofsuch special road district shall make demand therefor.

3. Except as provided in subsection 4 of this section, thespecial road district commissioners shall have sole, exclusiveand entire control and jurisdiction over all public highways,bridges and culverts, other than those controlled by thehighways and transportation commission, within the district, toconstruct, improve and repair such highways, bridges andculverts, and shall have all the power, rights and authorityconferred by law upon road overseers, and shall at all timeskeep such roads, bridges and culverts in as good condition asthe means at their command will permit, and for such purpose mayemploy competent people and road equipment at such compensationas they shall agree upon; rent, lease or buy road equipment,implements, tools and machinery; all kinds of motor power, andall things needed to carry on such work, except that the specialroad district commissioners may have such road work, or bridgeor culvert work, or any part thereof, done by contract, undersuch regulations as the special road district commissioners mayprescribe.

4. Any special road subdistrict established under theprovisions of sections 233.500 to 233.520 shall have concurrentcontrol and jurisdiction over all public highways, bridges andculverts, other than those controlled by the highways andtransportation commission, within the boundaries of the specialroad subdistrict with any special road district containing landwithin the boundaries of the special road subdistrict. Thespecial road subdistrict may contract with the special roaddistrict to use the tools and machinery described in subsection1 of this section.
