Projects, submission of plans to commission, approval--submission tolocal transportation authority, when.

238.225. 1. Before construction or funding of any project thedistrict shall submit the proposed project to the commission for its priorapproval. If the commission by minute finds that the project will improveor is a necessary or desirable extension of the state highways andtransportation system, the commission may preliminarily approve the projectsubject to the district providing plans and specifications for the proposedproject and making any revisions in the plans and specifications requiredby the commission and the district and commission entering into a mutuallysatisfactory agreement regarding development and future maintenance of theproject. After such preliminary approval, the district may impose andcollect such taxes and assessments as may be included in the commission'spreliminary approval. After the commission approves the final constructionplans and specifications, the district shall obtain prior commissionapproval of any modification of such plans or specifications.

2. If the proposed project is not intended to be merged into thestate highways and transportation system under the commission'sjurisdiction, the district shall also submit the proposed project andproposed plans and specifications to the local transportation authoritythat will become the owner of the project for its prior approval.

3. In those instances where a local transportation authority isrequired to approve a project and the commission determines that it has nodirect interest in that project, the commission may decline to consider theproject. Approval of the project shall then vest exclusively with thelocal transportation authority subject to the district making any revisionsin the plans and specifications required by the local transportationauthority and the district and the local transportation authority enteringinto a mutually satisfactory agreement regarding development and futuremaintenance of the project. After the local transportation authorityapproves the final construction plans and specifications, the districtshall obtain prior approval of the local transportation authority beforemodifying such plans or specifications.
