Embankments to be raised at expense of owner.

242.360. When any right-of-way has been obtained undersections 242.010 to 242.690, over any embankment belonging to anyperson, railroad, tramway or other corporation, it shall be theduty of the owner of such embankment to so raise at the expenseof the owner, said embankment so that same will conform with thelevee of said district, and if such person or corporation shallfail or refuse to raise such embankment in the manner hereinprovided, said district may within three months after it hasfinished the building of its own levee enter upon and raise theembankment of said person or corporation to conform with saiddistrict levee. And the cost for such construction shall be afirst lien upon the property of said person or corporation andsuch cost may be enforced in any court of competent jurisdiction.
