Secretary of board to file copy of plan with circuitclerk--commissioners appointed.

245.110. Within twenty days after the adoption of the planfor reclamation the secretary of the board of supervisors shallprepare and transmit a certified copy thereof to the circuitclerk of the court organizing the levee district, and at thesame time the board of supervisors shall file with the circuitclerk a petition asking the judge of such court to appointcommissioners to appraise the lands within and without thedistrict to be acquired for rights-of-way, holding basins andother works of the district, and to assess benefits and damagesaccruing to all lands in the district and other property byreason of the execution of the plan for reclamation. Withinthirty days after the filing of such petition the judge of suchcourt, either in term time or vacation, shall, by an order,appoint three commissioners, who shall be residents of the stateof Missouri, and who shall not be landowners in the district norof kin within the fourth degree of consanguinity to any personowning land in the district. A majority of the commissionersshall constitute a quorum and shall control the action of theboard on all questions.
