Ballot language for consolidation of sewer districts--submission ofquestion to voters in both districts simultaneously.

249.1106. 1. The ballot upon which the question of creating aconsolidated sewer district is submitted to the qualified voters residingwithin each existing sewer district or districts shall contain a questionin substantially the following form:

Shall the ............. (governing body's name) of ......... (county'sname) be authorized to dissolve the existing ................ (name ofexisting sewer district) and create a consolidated sewer district proposedfor the ............ (name of existing sewer districts to be consolidated)and authorize the consolidated sewer districts to incur indebtedness andissue general obligation bonds to pay for all or part of the cost of thecreation and maintenance of such consolidated sewer district, with the costof all indebtedness so incurred to be assessed by the ............. (nameof consolidated sewer district) on the property within the consolidatedsewer district?

If you are in favor of the question, place an "X" in the box opposite"Yes". If you are opposed to the question, place an "X" in the boxopposite "No".

If a majority of the total votes cast on the proposal by the qualifiedvoters of each existing district or districts voting thereon are in favorof the proposal, then the order shall become effective. If the proposalreceives less than the required majority in at least one existing district,then the governing body of the county shall have no power to impose theconsolidation of sewer districts as authorized pursuant to this sectionunless and until the governing body of the county shall again havesubmitted another proposal to authorize the governing body of the county toconsolidate authorized by this section and such proposal is approved by therequired majority of the total votes cast on the proposal by the qualifiedvoters of each existing district or districts voting on such proposal.

2. The boundaries of the proposed consolidated sewer district shallbe described by metes and bounds, streets or other sufficiently specificdescription.

3. There shall be separate submissions of the question of creating aconsolidated sewer district to each group of voters within each existingsewer district or districts, and the elections shall be heldsimultaneously.
