Right of condemnation--right to enter private land to survey--sewerlines across unplatted land, expense of construction and restoration.

249.540. 1. The county commission shall have the right tocondemn any land or other property within or without the districtfor right-of-way for sewers or for any other improvements orstructure deemed necessary or advisable for or in connection withthe sewer system of the district or districts, or for any of thepurposes provided in sections 249.430 to 249.660, and in so doingshall follow the procedure that is now provided by chapter 523,RSMo. The county commission shall also have the same authorityto enter upon private lands to survey land or other propertybefore exercise of the above condemnation powers as is grantedunder section 388.210, RSMo, to railroad corporations.

2. If it is necessary to construct a trunk sewer or similarsewage handling line across or on any land that has not beenplatted and such plat finally approved by the county planningcommission, county zoning commission, county planning and zoningcommission, or county governing body, the expenses incurred inconstructing such line and restoring the land across or on whichsuch line is located as near as possible to its former conditionshall be apportioned against the adjoining property, area, ordistricts served.
