Condemnation of land by board.

257.220. The board may condemn for the use of the district,any land or property within the district not previously acquiredor condemned by order or judgment of the court, according to theprocedure provided by law for the appropriation of land or otherproperty as provided in chapter 523, RSMo, for the condemnationof property for public use, except that:

(1) The original jurisdiction for such condemnation shallrest in the court as such court is defined in this chapter, and

(2) Any provisions of chapter 523, RSMo, which conflict withthe provisions of this chapter do not apply herein. Whenever theconstitution of the state permits, the board shall have the rightto exercise the power of excess condemnation on such property asthe court decrees as reasonable and desirable for the district toacquire.
