Restriction on sales of certain batteries, effective dates--sale ofnonbutton cell mercuric-oxide battery requirements, duties ofmanufacturer, violation, penalty.

260.267. 1. No person shall sell, offer for sale, or offer forpromotional purposes any alkaline-manganese battery manufactured on orafter January 1, 1997, with any mercury content that was intentionallyintroduced, as distinguished from mercury that may be incidentally presentin other materials, except that the limitation on mercury content inalkaline-manganese button cell batteries shall be twenty-five milligrams ofmercury per button cell.

2. (1) No person shall sell, offer for sale, or offer forpromotional purposes for use in Missouri any button cell mercuric-oxidebattery on or after January 1, 1996.

(2) No person shall sell, offer for sale, or offer for promotionalpurposes for use in Missouri any nonbutton cell mercuric-oxide battery onor after January 1, 1996, unless the battery manufacturer does all of thefollowing:

(a) Identifies an approved collection site to which persons may sendused mercuric-oxide batteries for recycling or proper disposal;

(b) Informs each mercuric-oxide battery purchaser of the location ofthe collection site identified in paragraph (a) of this subdivision; and

(c) Informs each mercuric-oxide battery purchaser of a telephonenumber that the purchaser may call to receive information about returningused mercuric-oxide batteries for recycling or proper disposal.

3. A person in violation of this section shall, upon conviction, beguilty of a class C misdemeanor.
