Listing or proposed listing of site in registry, procedure toremove.

260.460. 1. Any owner or operator of a site proposed forlisting in the registry, or listed in the registry pursuant tosection 260.440, may petition the director for deletion of suchsite, modification of the site classification or modification ofany information regarding such site. No site shall be listed onthe registry until after the resolution of any appeal initiatedunder this section.

2. Within ninety days after the submittal of such petition,the commission may convene a hearing to review the action of thedirector. No less than thirty days prior to the hearing, thecommission shall cause a notice of hearing to be published in anewspaper of general circulation in the county in which the siteis located. The commission shall also notify in writing anyowner or operator of the site no less than thirty days prior tothe hearing.

3. No later than thirty days following receipt of thecomplete record or following the decision not to hold a hearing,the commission shall provide the owner or operator with awritten determination accompanied by reason therefor regardingaction taken on the petition. All final decisions of thecommission shall be reviewable under chapter 536, RSMo.

4. The department shall, within ten days of anydetermination, notify the local governments of jurisdictionwhenever a change is made in the registry pursuant to thissection.
