Definitions.

292.600. As used in sections 292.600 to 292.625, the following termsmean:

(1) "Department", the state department of public safety;

(2) "District or local emergency planning committee", a committeeestablished by the Missouri emergency response commission and may include oneor more counties or cities in Missouri;

(3) "Employer", a person engaged in business and including the state andany political subdivision thereof;

(4) "Hazardous substance", any substance which is:

(a) Listed in Title III, Emergency Planning and Community Right-to-Know,of the federal Superfund Amendments and Reauthorization Act of 1986, PublicLaw 99-499; or

(b) A pesticide for which a registration has been canceled or suspendedunder the provisions of section 281.260, RSMo, or the federal Insecticide,Fungicide and Rodenticide Act of 1972, Public Law 92-516, as amended; or

(c) An extremely hazardous substance or hazardous chemical as defined inTitle III, Emergency Planning and Community Right-to-Know, as enacted underthe federal Superfund Amendments and Reauthorization Act of 1986, Public Law99-499; and which an employer stores, uses or produces, but shall not includeany substance which is a food or drug as defined in the federal Food, Drug andCosmetic Act, 21 U.S.C., Section 321, et seq.; packaged for distribution to,and used by, the general public, including any product used by an employer inthe same form, approximate amount, concentration, and manner as it is sold tothe consumer; present in a physical state, volume, or concentration for whichthere is no valid and substantial evidence that a significant risk to humanhealth may occur from exposure; used in a laboratory for experimentation,research, development or testing by or under the direct supervision of atechnically qualified individual, provided that the toxic substance or mixtureis not produced in the laboratory for commercial purposes;

(5) "Person", one or more individuals, partnerships, associations,corporations, business trusts, legal representatives or any organized group ofpersons.
