State inspection for dust--waterlines to be installed, when,sprinkling.

293.570. The director of the division of mine inspection andthe inspectors are hereby authorized, empowered and directed tothoroughly inspect all underground excavations in all mines otherthan coal mines, as often as the director of the division of mineinspection may deem proper, for the purpose of ascertaining ordiscovering in the air in any such mine or mines the presence ofdust in such quantities as shall be injurious to the health ofemployees engaged in working in such underground excavation; andupon finding dust in the air of any such mine in such quantitiesas shall tend to injure the health of the employees of such mine,such director or inspector shall immediately notify the owner,managing agent or operator of such mine, in writing, specifyingthe underground excavation so found to contain dust particles asaforesaid in the air thereof, and such owner, agent or operatorof such mine shall within fifteen days after receiving suchwritten notice, provide, install, equip, and thereafter at alltimes, maintain in such mine an independent waterline, fullyequipped and in good serviceable working order and repair,leading up to the face of any and all drifts where such dust isproduced, or so close to the face of said drifts so that by theuse of suitable hose extension or sprinkling attachments to besupplied by the owner or owners of said mine, the mineral orearth in and adjoining the face of the drift or drifts of suchmine can be sprinkled or wet by water from said pipeline,thereupon and thereafter every person drilling, squibbing orblasting in said mine shall keep the face, surface and drillholes in said drift or drifts wet or moist by the use of waterfrom said waterline to such an extent and in such a way as shallprevent, as far as possible, any dust raising from the working ofany such face or from the drilling, "blowing" or "shooting" ofany hole or holes; and the ground boss in charge of theunderground in any such mine, so equipped with a waterline, shallrequire all ground or dirt after being shot or blasted to bethoroughly wet or sprinkled to such an extent as shall prevent,as far as possible, any dust from arising therefrom while theemployees are at work therein.
