Fox trotter--state horse special license plates, application, fee.

301.3126. 1. Any member of the Missouri Fox Trotting Horse BreedAssociation may receive special license plates as prescribed by thissection, for any motor vehicle such person owns, either solely or jointly,other than an apportioned motor vehicle or a commercial motor vehiclelicensed in excess of eighteen thousand pounds gross weight, after anannual payment of an emblem-use authorization fee to the Missouri FoxTrotting Horse Breed Association of which the person is a member. TheMissouri Fox Trotting Horse Breed Association hereby authorizes the use ofits official emblem to be affixed on multiyear personalized license platesas provided in this section. Any contribution to the Missouri Fox TrottingHorse Breed Association derived from this section, except reasonableadministrative costs, shall be used solely for the purposes of the MissouriFox Trotting Horse Breed Association. Any member of the Missouri FoxTrotting Horse Breed Association may annually apply for the use of theemblem.

2. Upon annual application and payment of a twenty-five dollaremblem-use contribution to the Missouri Fox Trotting Horse BreedAssociation, the organization shall issue to the vehicle owner, withoutfurther charge, an emblem-use authorization statement, which shall bepresented by the owner to the department of revenue at the time ofregistration of a motor vehicle. Upon presentation of the annualstatement, payment of a fifteen dollar fee in addition to the registrationfee and documents which may be required by law, the department of revenueshall issue to the vehicle owner a personalized license plate which shallbear the emblem of the Missouri Fox Trotting Horse Breed Association andshall bear the words "FOX TROTTER - STATE HORSE" in place of the words"SHOW-ME STATE". Notwithstanding the provisions of section 301.144, noadditional fee shall be charged for the personalization of license platespursuant to this section. Such license plates shall be made with fullyreflective material with a common color scheme and design, shall be clearlyvisible at night, and shall be aesthetically attractive, as prescribed bysection 301.130.

3. A vehicle owner, who was previously issued a plate with theMissouri Fox Trotting Horse Breed Association emblem authorized by thissection but who does not provide an emblem-use authorization statement at asubsequent time of registration, shall be issued a new plate which does notbear the Missouri Fox Trotting Horse Breed Association emblem, as otherwiseprovided by law. The director of revenue shall make necessary rules andregulations for the administration of this section, and shall design allnecessary forms required by this section. No rule or portion of a rulepromulgated pursuant to the authority of this section shall becomeeffective unless it has been promulgated pursuant to the provisions ofchapter 536, RSMo. Any rule or portion of a rule, as that term is definedin section 536.010, RSMo, that is created under the authority delegated inthis section shall become effective only if it complies with and is subjectto all of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date, or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2004, shall beinvalid and void.
