301.3132. 1. Any member of or designated by the Missouri Society ofProfessional Engineers may receive special license plates as prescribed bythis section, for any motor vehicle such person owns, either solely orjointly, other than an apportioned motor vehicle or a commercial motorvehicle licensed in excess of eighteen thousand pounds gross weight, afteran annual payment of an emblem-use authorization fee to the MissouriSociety of Professional Engineers Educational Foundation. The MissouriSociety of Professional Engineers hereby authorizes the use of its officialemblem to be affixed on multiyear personalized license plates as providedin this section. Any contribution to the Missouri Society of ProfessionalEngineers Educational Foundation derived from this section, exceptreasonable administrative costs, shall be used solely for the purposes ofthe Missouri Society of Professional Engineers Educational Foundation andshall be deposited into the society's educational fund. Any member of orperson designated by the Missouri Society of Professional Engineers mayannually apply for the use of the emblem.
2. Upon annual application and annual payment of a twenty-five dollaremblem-use contribution to the Missouri Society of Professional EngineersEducational Foundation, the organization shall issue to the vehicle owner,without further charge, an emblem-use authorization statement, which shallbe presented by the owner to the department of revenue at the time ofregistration of a motor vehicle. Upon presentation of the annualstatement, payment of a fifteen dollar fee in addition to the registrationfee and documents which may be required by law, the department of revenueshall issue to the vehicle owner a personalized license plate which shallbear the emblem of the Missouri Society of Professional Engineers and thewords "MISSOURI SOCIETY OF PROFESSIONAL ENGINEERS" in place of the words"SHOW-ME STATE". Such license plates shall be made with fully reflectivematerial with a common color scheme and design, shall be clearly visible atnight, and shall be aesthetically attractive, as prescribed by section301.130. Notwithstanding the provisions of section 301.144, no additionalfee shall be added or charged for the personalization of license platesissued pursuant to this section.
3. A vehicle owner, who was previously issued a plate with theMissouri Society of Professional Engineers' emblem authorized by thissection but who does not provide an emblem-use authorization statement atthe subsequent time of registration, shall be issued a new plate which doesnot bear the Missouri Society of Professional Engineers' emblem, asotherwise provided by law.
4. The director of the department of revenue shall make necessaryrules and regulations for the administration of this section, and shalldesign all necessary forms required by this section. No rule or portion ofa rule promulgated pursuant to the authority of this section shall becomeeffective unless it has been promulgated pursuant to the provisions ofchapter 536, RSMo. Any rule or portion of a rule, as that term is definedin section 536.010, RSMo, that is created under the authority delegated inthis section shall become effective only if it complies with and is subjectto all of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date, or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2004, shall beinvalid and void.
