Boy Scouts of America special license plates, application, fee.

301.3139. 1. Any Boy Scout of appropriate age as prescribed by law orparent of a Boy Scout may receive special license plates as prescribed by thissection, for any motor vehicle such person owns, either solely or jointly,other than an apportioned motor vehicle or a commercial motor vehicle licensedin excess of eighteen thousand pounds gross weight, after an annual payment ofan emblem-use authorization fee to the Boy Scouts of America Council of whichthe person is a member or the parent of a member. The Boy Scouts of Americahereby authorizes the use of its official emblem to be affixed on multiyearpersonalized license plates as provided in this section. Any contribution tothe Boy Scouts of America derived from this section, except reasonableadministrative costs, shall be used solely for the purposes of the Boy Scoutsof America. Any Boy Scout or parent of a Boy Scout may annually apply for theuse of the emblem and pay the twenty-five dollar emblem-use authorization feeat any local district council in the state.

2. Upon annual application and payment of a twenty-five dollaremblem-use contribution to the Boy Scouts of America, the organization shallissue to the vehicle owner, without further charge, an emblem-useauthorization statement, which shall be presented by the owner to thedepartment of revenue at the time of registration of a motor vehicle. Uponpresentation of the annual statement, payment of a fifteen dollar fee inaddition to the registration fee and documents which may be required by law,the department of revenue shall issue to the vehicle owner a personalizedlicense plate which shall bear the emblem of the Boy Scouts of America and thewords "BOY SCOUTS OF AMERICA" in place of the words "SHOW-ME STATE". Suchlicense plates shall be made with fully reflective material with a commoncolor scheme and design, shall be clearly visible at night, and shall beaesthetically attractive, as prescribed by section 301.130. Notwithstandingthe provisions of section 301.144, no additional fee shall be charged for thepersonalization of license plates pursuant to this section.

3. A vehicle owner, who was previously issued a plate with the BoyScouts of America emblem authorized by this section but who does not providean emblem-use authorization statement at a subsequent time of registration,shall be issued a new plate which does not bear the Boy Scouts of Americaemblem, as otherwise provided by law. The director of revenue shall makenecessary rules and regulations for the administration of this section, andshall design all necessary forms required by this section. No rule or portionof a rule promulgated pursuant to the authority of this section shall becomeeffective unless it has been promulgated pursuant to the provisions of chapter536, RSMo. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in this sectionshall become effective only if it complies with and is subject to all of theprovisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo.This section and chapter 536, RSMo, are nonseverable and if any of the powersvested with the general assembly pursuant to chapter 536, RSMo, to review, todelay the effective date, or to disapprove and annul a rule are subsequentlyheld unconstitutional, then the grant of rulemaking authority and any ruleproposed or adopted after August 28, 2004, shall be invalid and void.
