Military killed in line of duty special license plates, applicationby immediate family members, fee.

301.3142. 1. Any immediate family member, including stepsiblings orstepchildren, who wishes to pay tribute to a member of the United Statesmilitary who was a resident of this state and who was killed in the line ofduty may receive special license plates as prescribed by this section, forany motor vehicle such person owns, either solely or jointly, other than anapportioned motor vehicle or a commercial motor vehicle licensed in excessof eighteen thousand pounds gross weight.

2. Upon annual application payment of a fifteen dollar fee inaddition to the registration fee, and presentation of any other documentswhich may be required by law or upon biennial application, payment of athirty dollar fee in addition to the registration fee and presentation ofproof of eligibility for such plates, and presentation of any otherdocuments which may be required by law, the department of revenue may issueto the vehicle owner a personalized license plate which shall bear theinitials of the member of the United States military killed while in theline of duty, a gold star on the left side of the plates, followed by athree-letter description of the relative's relation to the veteran,provided such license plate configuration is not currently in use, andwhich shall bear the words "WE SHALL NOT FORGET" in place of the words"SHOW-ME STATE". Such license plates shall be made with fully reflectivematerial with a common color scheme and design, shall be clearly visible atnight, and shall be aesthetically attractive, as prescribed by section301.130. Notwithstanding the provisions of section 301.144, no additionalfee shall be charged for the personalization of license plates pursuant tothis section.

3. License plates issued pursuant to the provisions of this sectionshall not be transferable to any other person except that any registeredco-owner of the motor vehicle shall be entitled to operate the motorvehicle with such plates for the duration of the year licensed in the eventof the death of the qualified person. The director of revenue shall makenecessary rules and regulations for the administration of this section, andshall design all necessary forms required by this section. Any rule orportion of a rule, as that term is defined in section 536.010, RSMo, thatis created under the authority delegated in this section shall becomeeffective only if it complies with and is subject to all of the provisionsof chapter 536, RSMo, and, if applicable, section 536.028, RSMo. Thissection and chapter 536, RSMo, are nonseverable and if any of the powersvested with the general assembly pursuant to chapter 536, RSMo, to review,to delay the effective date, or to disapprove and annul a rule aresubsequently held unconstitutional, then the grant of rulemaking authorityand any rule proposed or adopted after August 28, 2004, shall be invalidand void.
