School buses and other district vehicles, use to be regulated byboard--field trips in common carriers, regulationauthorized--violation by employee, effect--design of schoolbuses, regulated by board--St. Louis County buses may use word"special".

304.060. 1. The state board of education shall adopt andenforce regulations not inconsistent with law to cover the designand operation of all school buses used for the transportation ofschool children when owned and operated by any school district orprivately owned and operated under contract with any schooldistrict in this state, and such regulations shall by referencebe made a part of any such contract with a school district. Thestate board of education may adopt rules and regulationsgoverning the use of other vehicles owned by a district oroperated under contract with any school district in this stateand used for the purpose of transporting school children. Theoperator of such vehicle shall be licensed in accordance withsection 302.272, RSMo, and such vehicle shall transport no morechildren than the manufacturer suggests as appropriate for suchvehicle. The state board of education may also adopt rules andregulations governing the use of authorized common carriers forthe transportation of students on field trips or other specialtrips for educational purposes. Every school district, itsofficers and employees, and every person employed under contractby a school district shall be subject to such regulations. Thestate board of education shall cooperate with the statetransportation department and the state highway patrol inplacing suitable warning signs at intervals on the highways ofthe state.

2. Any officer or employee of any school district whoviolates any of the regulations or fails to include obligation tocomply with such regulations in any contract executed by him onbehalf of a school district shall be guilty of misconduct andsubject to removal from office or employment. Any personoperating a school bus under contract with a school district whofails to comply with any such regulations shall be guilty ofbreach of contract and such contract shall be canceled afternotice and hearing by the responsible officers of such schooldistrict.

3. Any other provision of the law to the contrarynotwithstanding, in any county of the first class with a charterform of government adjoining a city not within a county, schoolbuses may bear the word "special".
