Civil actions permitted, when.

311.685. 1. Any retail licensee selling intoxicating liquor underthis chapter and aggrieved by official action of the supervisor affectingthe licensee may bring a civil action against any person who is theproximate cause of such official action by the supervisor, if the violationoccurred on or about the premises of the retail licensee. If a judgment isentered in favor of the licensee, the court shall award the retail licenseecivil damages up to an amount of five thousand dollars and shall awardreasonable court costs and attorney fees.

2. No civil action shall be brought under this section against anyemployee of the supervisor of alcohol and tobacco control or any lawenforcement officer.
