Missouri breeders fund,created--administration--costs--audit--rules--fund not to lapseinto general revenue fund.

313.720. 1. There is hereby created a "Missouri Breeders Fund",which shall not represent revenue collected and moneys received by thestate.

2. The fund shall consist of those funds set aside for breederincentives as provided in section 313.710, such registration fees for theowners and breeders of Missouri bred horses as the commission may provideby rule, such gifts, or bequests as the fund may from time to time receiveand such funds as the general assembly may provide. Any gift or bequestshall be credited to such account as the donor or devisee may provide. Ifno specific account is provided by the donor or designee, such gift orbequest shall be divided equally among the three accounts.

3. The Missouri breeders fund shall be administered by thecommission, with the advice and assistance of advisory committeesdesignated for that purpose by the rules of the commission. The commissionshall, at least biennially, carry out such audits as provided by rule. Thecosts of administration shall be borne by the fund. The commission shallhave authority to promulgate such rules as may be necessary or desirablefor the efficient operation of the Missouri breeders fund and to provideincentives for breeders and owners of Missouri bred horses.

4. The Missouri breeders fund shall not lapse and the interest earnedon such fund shall be credited to the fund. The provisions of section33.080, RSMo, to the contrary notwithstanding, funds in the Missouribreeders fund shall not be transferred and placed to the credit of thegeneral revenue fund at the end of each biennium.
