Board duties.

324.159. The board shall:

(1) Adopt and publish a code of ethics;

(2) Establish the qualifications and fitness of applicants oflicenses, renewal of licenses and reciprocal licenses;

(3) Revoke, suspend or deny a license, suspend a license or reprimanda license holder for a violation of sections 324.125 to 324.183, the codeof ethics or the rules adopted by the board;

(4) Provide for the expenditure of funds necessary for the properadministration of its assigned duties;

(5) Establish reasonable and necessary fees for the administrationand implementation of sections 324.125 to 324.183. Fees shall beestablished at a rate that does not significantly exceed the cost ofadministering the provisions of sections 324.125 to 324.183;

(6) Establish continuing professional education requirements forlicensed clinical perfusionists and provisional licensed clinicalperfusionists, the standards of which shall be at least as stringent asthose of the American Board of Cardiovascular Perfusion or its successoragency;

(7) Within the limits of its appropriation, employ and remove boardpersonnel, as defined in subdivision (4) of subsection 10 of section324.001 as may be necessary for the efficient operation of the board;

(8) Adopt the training and clinical competency requirementsestablished by the department of health and senior services throughhospital licensing regulations promulgated pursuant to chapter 197, RSMo.The provisions of sections 324.125 to 324.183 to the contrarynotwithstanding, the board shall not regulate a perfusionist's training,education or fitness to practice except as specifically provided by thehospital licensing regulations of the department of health and seniorservices. In promulgating such regulations, the department of health andsenior services shall adopt the standards of the American Board ofCardiovascular Perfusion, or its successor organization, or comparablestandards for training and experience. The department shall by rule andregulation provide that individuals providing perfusion services who domeet such standards may continue their employment in accordance withsection 324.130. The department shall also establish standards forprovisional licensed clinical perfusionists pursuant to section 324.147.
