Advisory commission for clinical perfusionists established, duties,members, expenses, compensation, removal.

324.177. 1. There is hereby established an "Advisory Commission forClinical Perfusionists" which shall guide, advise and make recommendationsto the board. The commission shall approve the examination required bysection 324.133 and shall assist the board in carrying out the provisionsof sections 324.125 to 324.183.

2. The advisory commission shall consist of five perfusionist membersand two public members which shall be appointed by the governor with theadvice and consent of the senate. The members of the commission shall beappointed for terms of six years; except those first appointed, of whichone shall be appointed for a term of one year, one shall be appointed for aterm of two years, one shall be appointed for a term of three years, oneshall be appointed for a term of four years, one shall be appointed for aterm of five years and one shall be appointed for a term of six years. Thenonpublic commission members shall be residents of the state of Missourifor at least one year, shall be United States citizens and shall meet allthe requirements for licensing provided in sections 324.125 to 324.183,shall be licensed pursuant to sections 324.125 to 324.183, except themembers of the first commission, who shall be licensed within six months oftheir appointment and are actively engaged in the practice of perfusion.If a member of the commission shall, during the member's term as acommission member, remove the member's domicile from the state of Missouri,then the commission shall immediately notify the governor and the seat ofthat commission member shall be declared vacant. All such vacancies shallbe filled by appointment as in the same manner as the precedingappointment. The public members shall be at the time of the members'appointment citizens of the United States; residents of the state for aperiod of at least one year and registered voters; persons who are not andnever were members of any profession licensed or regulated pursuant tosections 324.125 to 324.183 or the spouse of such person; persons who donot have and never have had a material, financial interest in either theprovision of the professional services regulated by sections 324.125 to324.183, or an activity or organization directly related to any professionlicensed or regulated by sections 324.125 to 324.183.

3. Notwithstanding any other provision of law to the contrary, anyappointed member of the commission shall receive as compensation an amountestablished by the director of the division of professional registrationnot to exceed seventy dollars per day for commission business plus actualand necessary expenses. The director of the division of professionalregistration shall establish by rule guidelines for payment. All staff forthe commission shall be provided by the division of professionalregistration.

4. A member of the commission may be removed if the member:

(1) Does not have, at the time of appointment, the qualificationsrequired for appointment to the commission;

(2) Does not maintain during service on the commission thequalifications required for appointment to the commission;

(3) Violates any provision of sections 324.125 to 324.183;

(4) Cannot discharge the member's duties for a substantial part ofthe term for which the member is appointed because of illness ordisability; or

(5) Is absent from more than half of the regularly scheduledcommission meetings that the member is eligible to attend during a calendaryear, unless the absence is excused by a majority vote of the commission.
