Board of podiatricmedicine--appointment--terms--compensation--qualifications.

330.110. 1. The board shall be composed of five members includingone voting public member, to be appointed by the governor with the adviceand consent of the senate. Vacancies on the board shall be filled in likemanner. The term of office of each member shall be four years. Eachmember of the board shall receive as compensation an amount set by theboard not to exceed seventy dollars for each day devoted to the affairs ofthe board, and shall be entitled to reimbursement of the member's expensesnecessarily incurred in the discharge of the member's official duties. Allmembers of the board, except the public member, shall be doctors ofsurgical podiatric medicine duly registered and licensed pursuant to thelaws of this state, shall be United States citizens, shall have beenresidents of this state for at least one year next preceding theirappointment and shall have been engaged in the lawful and ethical practiceof podiatric medicine for a period of not less than five years. Not morethan two of the podiatrists shall belong to the same political party.Members of the board shall not be directly or indirectly interested in anypodiatric medical college or the podiatric medical department of anyinstitution of higher learning or in any podiatric medical supply or shoebusiness. The president of the Missouri Podiatric Medical Association inoffice at the time shall, at least ninety days prior to the expiration ofthe term of a board member, other than the public member, or as soon asfeasible after a vacancy on the board otherwise occurs, submit to thedirector of the division of professional registration a list of fivedoctors of surgical podiatric medicine qualified and willing to fill thevacancy in question, with the request and recommendation that the governorappoint one of the five persons so listed, and with the list so submitted,the president of the Missouri Podiatric Medical Association shall includein his or her letter of transmittal a description of the method by whichthe names were chosen by that association.

2. The public member shall be at the time of the member's appointmenta citizen of the United States; a resident of this state for a period ofone year and a registered voter; a person who is not and never was a memberof any profession licensed or regulated pursuant to this chapter or thespouse of such person; and a person who does not have and never has had amaterial, financial interest in either the providing of the professionalservices regulated by this chapter, or an activity or organization directlyrelated to any profession licensed or regulated pursuant to this chapter.All members, including public members, shall be chosen from lists submittedby the director of the division of professional registration. The dutiesof the public member shall not include the determination of the technicalrequirements to be met for licensure or whether any person meets suchtechnical requirements or of the technical competence or technical judgmentof a licensee or a candidate for licensure.
