Fees, collection and disposition--board fund established, transferredto general revenue, when.

330.150. 1. All fees provided for in this chapter shall be payableto the director of the division of professional registration who shall keepa record of the account showing the total payments received and shallimmediately transmit same to the department of revenue for deposit in thestate treasury to the credit of a fund to be known as the "State Board ofPodiatric Medicine Fund". All the salaries and expenses for the operationof the board shall be appropriated and paid from such fund; provided,however, the board shall create no expense exceeding the sum received fromtime to time as fees as provided by law. Any funds remaining in the stateboard of podiatry fund on August 28, 1995, shall be transferred to thestate board of podiatric medicine fund.

2. The provisions of section 33.080, RSMo, to the contrarynotwithstanding, money in this fund shall not be transferred and placed tothe credit of general revenue until the amount in the fund at the end ofthe biennium exceeds two times the amount of the appropriation from theboard's funds for the preceding fiscal year or, if the board requires, byrule, permit renewal less frequently than yearly, then three times theappropriation from the board's funds for the preceding fiscal year. Theamount, if any, in the fund which shall lapse is that amount in the fundwhich exceeds the appropriate multiple of the appropriation from theboard's funds for the preceding fiscal year.
