Fees, how set, collection and disposition--board fund established,transferred to general revenue, when--salaries and expenses, how paid.

331.070. 1. The board shall set the amount of the feeswhich this chapter authorizes and requires by rules andregulations promulgated pursuant to section 536.021, RSMo. Thefees shall be set at a level to produce revenue which shall notsubstantially exceed the cost and expense of administering thischapter. All fees provided for in this chapter shall becollected by the director of the division of professionalregistration who shall transmit them to the department of revenuefor deposit in the state treasury to the credit of a fund to beknown as the "State Board of Chiropractic Examiners' Fund". Allthe salaries and expenses for the operation of the board shall beappropriated and paid from such fund; provided, however, theboard shall create no expense exceeding the sum received fromtime to time as fees.

2. The provisions of section 33.080, RSMo, to the contrarynotwithstanding, money in this fund shall not be transferred andplaced to the credit of general revenue until the amount in thefund at the end of the biennium exceeds two times the amount ofthe appropriation from the board's funds for the preceding fiscalyear or, if the board requires by rule permit renewal lessfrequently than yearly, then three times the appropriation fromthe board's funds for the preceding fiscal year. The amount, ifany, in the fund which shall lapse is that amount in the fundwhich exceeds the appropriate multiple of the appropriations fromthe board's funds for the preceding fiscal year.
