Dentists to have sedation or anesthesia permits--sedation oranesthesia prescribed or administered, how--site certificaterequired--rulemaking authority.

332.362. 1. All duly registered and currently licensed dentists inMissouri who prescribe and administer deep sedation or general anesthesiaagents in the course of providing dental services shall possess a deepsedation or general anesthesia permit issued by the board. All dulyregistered and currently licensed dentists in Missouri who prescribe andadminister conscious sedation agents in the course of providing dentalservices shall possess a conscious sedation permit issued by the board.

2. Dentists prescribing or administering deep sedation or generalanesthesia or conscious sedation agents shall do so in accordance withrules set forth by the board.

3. Any dental office where deep sedation or general anesthesia orconscious sedation agents are administered shall possess a site certificateissued by the board and comply with the board's minimum standard for sitecertificates.

4. The board may promulgate rules specifying the criteria by whichdeep sedation or general anesthesia permits, conscious sedation permits,and site certificates may be issued, renewed, or revoked and standards forprescribing and administering deep sedation or general anesthesia orconscious sedation agents within the dental setting. Such rules shall onlyapply to entities regulated under this chapter.

5. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in thissection shall become effective only if it complies with and is subject toall of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date, or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2004, shall beinvalid and void.
