Fund created, use, funds transferred to general revenue, when.

333.231. 1. All fees payable under this chapter shall becollected by the division of professional registration andtransmitted to the department of revenue for deposit in the statetreasury to the credit of the fund to be known as the "Board ofEmbalmers and Funeral Directors' Fund".

2. All compensation of board members and employees and allexpenses incident to the administration of this chapter shall bepaid out of the board of embalmers and funeral directors' fund.No expense of this board shall ever be paid out of any other fundof the state, either by deficiency bill or otherwise.

3. The provisions of section 33.080, RSMo, to the contrarynotwithstanding, money in this fund shall not be transferred andplaced to the credit of general revenue until the amount in thefund at the end of the biennium exceeds two times the amount ofthe appropriation from the board's funds for the preceding fiscalyear or, if the board requires by rule permit renewal lessfrequently than yearly, then three times the appropriation fromthe board's funds for the preceding fiscal year. The amount, ifany, in the fund which shall lapse is that amount in the fundwhich exceeds the appropriate multiple of the appropriations fromthe board's funds for the preceding fiscal year.
