Injunctive relief authorized, when.

333.335. 1. Upon application by the board and the necessary burdenhaving been met, a court of competent jurisdiction may grant an injunction,restraining order, or other order as may be appropriate to enjoin a personfrom:

(1) Offering to engage or engaging in the performance of any acts orpractices for which a registration or authority, permit, or license isrequired by sections 333.310 to 333.340, upon a showing that such acts orpractices were performed or offered to be performed without the requiredregistration or authority, permit, or license; or

(2) Engaging in any practice or business authorized by a registrationor authority, permit, or license issued under this chapter that is inviolation of this chapter or sections 436.400 to 436.520, RSMo, or upon ashowing that the holder presents a substantial probability of seriousdanger to the health, safety, or welfare of any resident of this state orclient or customer of the licensee or registrant; or

(3) Engaging in any practice or business that presents a substantialprobability of serious danger to the solvency of any seller.

2. Any such action shall be commenced in the county in which suchconduct occurred or in the county in which the defendant resides or, in thecase of a firm or corporation, where the firm or corporation maintains itsprincipal office or in Cole County.

3. Any action brought under this section shall be in addition to andnot in lieu of any authority provided by this chapter, and may be broughtconcurrently with other actions to enforce this chapter or sections 436.400to 436.520, RSMo.
