Fees, collection and disposition--fund, source, use, transferredto general revenue, when.

339.070. 1. All fees and charges payable under this chaptershall be collected by the division of professional registrationand transmitted to the department of revenue for deposit in thestate treasury to the credit of the "Real Estate CommissionFund". No money shall be paid out of this fund except by anappropriation by the general assembly. Warrants shall be issuedmonthly, upon the state treasurer out of this fund only, for thepayment of the salaries and all necessary expenses of thecommission. Vouchers for salaries and expenses shall be firstapproved by the commission. The total expense for every purposeincurred by the commission shall not exceed the total fees andcharges collected and paid into the state treasury.

2. The provisions of section 33.080, RSMo, to the contrarynotwithstanding, money in this fund shall not be transferred andplaced to the credit of general revenue until the amount in thefund at the end of the biennium exceeds two times the amount ofthe appropriation from the board's funds for the preceding fiscalyear or, if the board requires by rule permit renewal lessfrequently than yearly, then three times the appropriation fromthe board's funds for the preceding fiscal year. The amount, ifany, in the fund which shall lapse is that amount in the fundwhich exceeds the appropriate multiple of the appropriations fromthe board's funds for the preceding fiscal year.
