Continuing education requirements for renewal or accepted otherstudies and projects.

339.530. 1. As a prerequisite of renewal of certification orlicensure, a state-certified real estate appraiser or state-licensed realestate appraiser shall present evidence satisfactory to the commission ofhaving met the continuing education requirements as provided in thissection. The basic continuing education requirements for renewal ofcertification or licensure shall be the completion by the state-certifiedreal estate appraiser or state-licensed real estate appraiser, during theimmediately preceding term of certification or licensure, of continuingeducation as prescribed by the appraiser qualifications board and approvedby the commission.

2. In lieu of meeting the requirements of subsection 1 of thissection, an applicant for renewal of certification or licensure may satisfyall or part of the requirements of this section by presenting evidence ofthe following:

(1) Completion of courses of study determined by the commission to beequivalent, for continuing education purposes, to courses approved by thecommission pursuant to subsection 1 of this section;

(2) Participation, other than as a student, in educational processesand programs in real property appraisal theory, practices, or techniques,including, but not limited to, teaching, program development, andpreparation of textbooks, monographs, articles, and other instructionalmaterials, all to be approved by the commission.

3. The commission shall adopt regulations for implementation of theprovisions of this section to assure that state-certified real estateappraisers renewing their certifications and state-licensed real estateappraisers renewing their licenses have current knowledge of real propertyappraisal theories, practices, and techniques which will provide a highdegree of service and protection to those members of the public with whomthey deal in a professional relationship under authority of thecertification or licensure. Such regulations shall prescribe thefollowing:

(1) Policies and procedures for obtaining commission approval ofcourses of instruction pursuant to this section;

(2) Standards, policies, and procedures to be applied by thecommission in evaluating an applicant's claims of equivalency pursuant tothis section;

(3) Standards, monitoring methods, and systems for recordingattendance to be employed by course sponsors as a prerequisite tocommission approval of courses for credit.

4. In adopting regulations pursuant to this section, the commissionshall give favorable consideration to courses of instruction, seminars, andother real property appraisal education courses or programs previously orhereafter developed by or under the auspices of professional appraisalorganizations and utilized by those associations for purposes ofdesignation, certification, licensure, recertification or relicensure ofthe members of the association.

5. No amendment or repeal of a regulation adopted by the commissionpursuant to this section shall operate to deprive a state-certified realestate appraiser or state-licensed real estate appraiser of credit towardrenewal of certification or licensure for any course of instructioncompleted prior to the amendment or repeal of the regulation, if the coursewould have qualified for continuing education credit under the regulationas it existed prior to the repeal or amendment.
