Hearing instrument specialist fund, created, uses--amount of fund tolapse.

346.135. 1. All fees and charges payable pursuant to this chaptershall be collected by the division and transmitted to the department ofrevenue for deposit in the state treasury to the credit of the fund to beknown as the "Hearing Instrument Specialist Fund", which is hereby created.Money in the hearing instrument specialist fund shall be available byappropriation to the council to pay its expenses in administering sections346.010 to 346.250.

2. Money in the hearing instrument specialist fund shall not betransferred and placed to the credit of general revenue until the amount inthe fund at the end of the biennium exceeds two times the amount of theappropriation from the council's funds for the preceding fiscal year or, ifthe division requires by rule renewal less frequently than yearly thenthree times the appropriation from the fund for the preceding fiscal year.The amount, if any, in the fund which shall lapse is that amount in thefund which exceeds the appropriate multiple of the appropriation from thecouncil's funds for the preceding year.
